International Institute for the Unification of Private Law

 

PURPOSE - The International Institute for the Unification of Private Law (UNIDROIT) is an independent intergovernmental Organisation with its seat in the Villa Aldobrandini in Rome. Its purpose is to study needs and methods for modernising, harmonising and co-ordinating private and in particular commercial law as between States and groups of States and to formulate uniform law instruments, principles and rules to achieve those objectives.

ORIGINS - Set up in 1926 as an auxiliary organ of the League of Nations, the Institute was, following the demise of the League, re-established in 1940 on the basis of a multilateral agreement, the UNIDROIT Statute.

UNIDROIT maintains close ties of co-operation with other international Organisations, both intergovernmental and nongovernmental, which in many cases take the form of co-operation agreements concluded at inter-Secretariat level. By reason of its expertise in the international unification of law, UNIDROIT is moreover at times commissioned by such other Organisations to prepare comparative law studies (and/or draft Conventions designed to serve as the basis for the preparation and/or finalization of international instruments in those Organisations (example of the 1954 UNESCO Convention for the Protection of Cultural Property in the Event of Armed Conflict).

The work on the 1995 UNIDROIT Convention on Stolen or Illegally Exported Cultural Objects started at the request of UNESCO in the early 80s'.

Essential support for UNIDROIT's core activity - that is the drawing up of uniform rules - is provided by its maintenance of a world-renowned library, its preparation of a number of specialised publications in the field of the unification of law, its legal cooperation programme and its periodic organisation of congresses, meetings and seminars.

VOCATION - L'Institut international pour l'unification du droit privé (UNIDROIT) est une organisation intergouvernementale indépendante dont le siège est à Rome dans la Villa Aldobrandini. Son objet est d'étudier des moyens et méthodes en vue de moderniser, harmoniser et coordonner le droit privé - en particulier le droit commercial - entre des Etats ou des groupes d'Etats et, à cette fin, d’élaborer des instruments de droit uniforme, des principes et des règles.

 

ORIGINES - L'Institut fut créé en 1926 comme organe auxiliaire de la Société des Nations; après la dissolution de celle-ci, il fut reconstitué en 1940 en vertu d'un accord multilatéral, le Statut organique d'UNIDROIT.

UNIDROIT entretient d'étroites relations avec d'autres organisations internationales, tant intergouvernementales que non gouvernementales, qui dans de nombreux cas prennent la forme d'accords de coopération entre les secrétariats. Compte tenu de sa compétence en matière d'unification du droit, certaines organisations peuvent faire appel à UNIDROIT pour la préparation d'études de droit comparé et/ou de projets de conventions destinés à poser les bases de l'élaboration ou de la mise au point d'instruments internationaux dans le cadre de ces organisations (exemple de la Convention de 1954 de l’UNESCO pour la Protection des biens culturels en cas de conflit armé). Le travail sur la Convention d’UNIDROIT sur les biens culturels volés ou illicitement exportés a débuté à la demande de l’UNESCO au début des années 80. 

En complément indispensable de la vocation centrale d'UNIDROIT comme centre de préparation de règles uniformes, on citera les activités suivantes: une bibliothèque de renommée mondiale, des publications spécialisées dans le domaine du droit uniforme, un programme de coopération juridique, un projet de centre de données sur le droit uniforme UNILAW et l'organisation périodique de congrès, rencontres et séminaires.
